SAFEOWL CARE WARRANTY TERMS AND CONDITIONS

Supplemental Extended Protection agreement & Customer Acknowledgment Governed under the Laws of the State of Texas, United States

IMPORTANT CONSUMER NOTICE:

PLEASE READ THIS SAFEOWL CARE WARRANTY TERMS AND CONDITIONS AGREEMENT (“AGREEMENT”) CAREFULLY. THIS AGREEMENT CONSTITUTES A BINDING LEGAL CONTRACT BETWEEN THE PURCHASER (“CUSTOMER,” “YOU,” OR “YOUR”) AND SAFEOWL, INC., LOCATED AT 8101 RIDGEPOINT DR., STE. 107, IRVING, TX 75063 (“SAFEOWL,” “COMPANY,” “WE,” “US,” OR “OUR”). BY PURCHASING, REGISTERING, OR ACTIVATING THE SAFEOWL CARE WARRANTY, OR BY CHECKING THE ACKNOWLEDGMENT BOX AT CHECKOUT, YOU AGREE TO BE BOUND BY ALL TERMS, CONDITIONS, LIMITATIONS, AND DISCLAIMERS CONTAINED HEREIN.

SECTION 1. DEFINITIONS

1.1 “SafeOwl Care Warranty” or “Plan” means this supplemental extended service contract provided by SafeOwl, offering eligible product replacement coverage subject to the terms hereof. Customer acknowledges that this Plan is an extended service contract regulated under applicable state service contract laws and is not an insurance policy or an extension of the baseline manufacturer limited warranty.

1.2 “Covered Product” means the specific SafeOwl Kids Watch unit identified by serial number, IMEI, or purchase invoice at the time of Plan enrollment.

1.3 “Coverage Period” means the eighteen (18) consecutive calendar month duration commencing exclusively on the date of confirmed purchase of this Plan (which must occur no later than thirty (30) calendar days following the original purchase date of the Covered Product, as set forth in Section 2.1).

1.4 “Replacement Limit” means the absolute maximum liability limit under this Plan, restricted strictly to one (1) replacement unit total during the entire Coverage Period.

1.5 “Territory” means all fifty (50) states of the United States of America and the District of Columbia.

SECTION 2. TERM, PURCHASE ELIGIBILITY & SCOPE OF COVERAGE

Coverage under the SafeOwl Care Warranty extends for a term of eighteen (18) consecutive calendar months as determined in accordance with Section 1.3. During the Coverage Period, SafeOwl warrants that if the Covered Product experiences operational breakdown, mechanical failure, or eligible accidental hardware damage occurring during normal, intended operational use, SafeOwl will, upon claim adjudication, issue one (1) replacement unit to Customer.

2.1 Purchase Eligibility Window (30-Day Limit):
This Plan may be purchased under either of the following eligibility windows:

  • Simultaneous Purchase: Concurrently with the Covered  product at the time of
    initial checkout or pre-order; or
  • Post-Purchase Enrollment: Separately, within thirty (30) calendar days of the original purchase date of the Covered Product, as evidenced by valid proof of purchase (such as an official order confirmation, store receipt, or invoice from SafeOwl or an authorized retailer).

Operational Condition Requirement: For any Plan purchased separately after the initial purchase date of the Covered Product, the Covered Product must be fully operational, intact, and completely free of hardware defects or accidental damage at the time of Plan enrollment. SafeOwl reserves the right to require electronic device diagnostic verification, serial number pairing validation, or physical condition attestation prior to approving coverage. Any attempted purchase of this Plan made more than thirty (30) calendar days after the original purchase date, or for an already damaged device, shall be void ab initio.

2.2 Replacement Limitation & Extinguishment of Obligations:
THIS PLAN PROVIDES A MAXIMUM OF ONE (1) REPLACEMENT UNIT TOTAL. SafeOwl may, at its sole discretion, fulfill an approved claim using a new or factory-recertified unit of like kind, quality, and functionality. If the original model, colorway, or edition is no longer available, SafeOwl will provide a functionally equivalent or upgraded unit.

Extinguishment & Replacement Warranty: UPON SAFEOWL’S DISPATCH OR  PROVISION OF SAID REPLACEMENT UNIT, SAFEOWL’S SERVICE OBLIGATIONS AND ALL ACCIDENTAL DAMAGE LIABILITIES UNDER THIS CARE WARRANTY PLAN ARE FULLY SATISFIED, EXTINGUISHED, AND PERMANENTLY CONCLUDED. NO FURTHER ACCIDENTAL DAMAGE CLAIMS, REPLACEMENTS, OR PLAN REFUNDS SHALL BE ISSUED THEREAFTER.

Defect Coverage on Replacement Unit: Notwithstanding such extinguishment, the replacement unit itself shall be warranted solely against manufacturer hardware defects for either ninety (90) calendar days from the date of physical delivery or the remaining balance of the Covered Product’s original baseline Manufacturer Limited Warranty, whichever duration is greater.

2.3 Included Accidental Damage:
Subject to the single (1) Replacement Limit under Section 1.4, covered accidental hardware damage includes cracked screens, broken outer casings, sudden internal component failure caused by accidental drops or physical impacts, and liquid ingress occurring from unintentional immersion or water exposure during standard child play.

2.4 Battery Degradation Threshold:
Device battery replacement is covered under this Plan only if the Covered Product’s internal rechargeable battery fails to hold at least eighty percent (80%) of its original factory electrical capacity, as verified by SafeOwl technical diagnostics. Gradual, normal reduction in battery runtime resulting from standard aging and regular recharge cycles is not covered.

2.5 Removable Bands & External Accessories Exclusion:
Wristbands, watch straps, buckles, screen protectors, charging cables, and power adapters are external accessories and are not Covered Products. Damage restricted solely to a wristband or charging accessory does not qualify for a replacement unit under Section 1.4.

2.6 Coverage Term, Non-Extension & Transferability:
The Coverage Period runs continuously from the initial commencement date determined under Section 1.3 and cannot be paused, suspended, or tolled. Under no circumstances shall a companion app unpairing, factory wipe, user reset, dormant period of non-use, or change of ownership extend, restart, or create a new Coverage Period.
Transfers to Secondary Owners: If ownership of the Covered Product is transferred:

  • Coverage applies solely to the unexpired remainder of the original 18-month Coverage Period;
  • The single (1) Replacement Limit remains strictly cumulative across the entire life of the device and does not renew upon resale; and
  • Any secondary claimant must provide the original purchase order number or valid proof of transfer to file a claim.

2.7 Independent Cellular Service Subscription & No Service Credits:
The Covered Product requires an active, proprietary SafeOwl cellular connectivity subscription to utilize cellular and GPS tracking features. Customer acknowledges and agrees that:

  • Separate Agreements: This Plan is strictly a hardware service contract and does not include, extend, or govern cellular connectivity, voice minutes, or data services, which are governed exclusively by the separate SafeOwl Cellular Terms of Service;
  • No Suspension/Tolling: Pausing, suspending, delinquent payment of, or canceling a cellular subscription does not suspend, toll, extend, or refund the 18-month Coverage Period under this Plan; and
  • No Cellular Credits for Claim Downtime: SafeOwl provides no service fee credits, cellular subscription refunds, or billing offsets for any period during which the Covered Product is damaged, defective, in transit, or awaiting replacement under this Plan.

SECTION 3. RELATIONSHIP TO STANDARD MANUFACTURER WARRANTY

3.1 Supplemental Protection:
This Plan operates as a supplemental service agreement and does not reduce, replace, or supersede the baseline SafeOwl Manufacturer Limited Warranty.

3.2 Non-Exhaustion on Factory Defects:
Hardware defects, component failures, or workmanship flaws occurring within the baseline manufacturer warranty period must be submitted under the standard manufacturer warranty. Repairs or replacements completed under the baseline Manufacturer Limited Warranty do not count toward or exhaust the one (1) Replacement Limit under this Plan. The one (1) accidental replacement benefit provided under Section 1.4 remains fully available for subsequent accidental damage throughout the Coverage Period.

SECTION 4. CLAIM FILING & ADJUDICATION PROCEDURES

4.1 Notice & Submission:
Claims must be submitted within the active 18-month Coverage Period through the official SafeOwl Customer Support channels: email at support@safeowl.com and live chat on the safeowl.com website.

4.2 Verification & Requirements:
Customer must provide valid proof of purchase, the Covered Product’s serial number or IMEI, a detailed description of the failure or damage, and complete diagnostic steps as reasonably requested by SafeOwl.

4.3 Adjudication & Return:
SafeOwl reserves the right to evaluate and adjudicate all submitted claims to verify coverage eligibility prior to authorizing a replacement unit. SafeOwl may require the return of the damaged Covered Product prior to releasing the replacement unit. For all authorized domestic claims within the Territory, SafeOwl will provide a prepaid return shipping label. Customer is solely responsible for packaging the device securely to prevent transit damage.

4.4 Parental Data Responsibility & Device Reset:
Prior to returning any Covered Product to SafeOwl, Customer is solely responsible for:

  • unpairing the device from the SafeOwl parental mobile application; and
  • executing a complete factory reset to wipe all local data.

SafeOwl disclaims all liability for residual cellular charges, active data connections, or personal data remaining on returned units.

SECTION 5. EXCLUSIONS FROM COVERAGE

5.1 Loss, theft, misplacement, or mysterious disappearance.

5.2 Intentional abuse, neglect, reckless conduct, severe physical destruction, or exposure to excessive environmental conditions outside product specifications (except as expressly covered under Section 2.3 for accidental liquid ingress during child play).

5.3 Cosmetic wear, scratches, or minor surface dents that do not impede functional device operation.

5.4 Unauthorized repairs, modifications, tampering, battery alteration, or physical/software attempts to unlock, bypass, or alter the integrated SIM, internal cellular antenna, or proprietary cellular modem configurations.

5.5 Third-party software, applications, malware, or firmware alterations.

5.6 Damage caused by force majeure, acts of God, fire, lightning, or war.

5.7 Any operational failure, cracked screen, liquid ingress, physical breakage, or component defect occurring prior to the specific date and time this Plan was purchased.

SECTION 6. LIMITATION OF LIABILITY & LEGAL DISCLAIMERS

6.1 DISCLAIMER OF CONSEQUENTIAL DAMAGES:
TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, SAFEOWL, ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE TO CUSTOMER OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES (INCLUDING LOSS OF DATA, INTERRUPTION OF USE, OR COVER COSTS) ARISING OUT OF OR CONNECTED WITH THIS PLAN, THE COVERED PRODUCT, OR THE USE OR INABILITY TO USE THE DEVICE.

6.2 MAXIMUM AGGREGATE LIABILITY:
SAFEOWL’S MAXIMUM CUMULATIVE AGGREGATE LIABILITY UNDER THIS PROTECTION PLAN IS STRICTLY LIMITED TO THE PROVISION OF ONE (1) REPLACEMENT UNIT OR THE ORIGINAL RETAIL PURCHASE PRICE PAID FOR THE PROTECTION PLAN. EXCEPT FOR EXPRESS WARRANTIES STATED HEREIN, SAFEOWL DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

6.3 NON-LIFE-SAFETY & EMERGENCY USE DISCLAIMER:
THE COVERED PRODUCT AND THIS PLAN ARE NOT A SUBSTITUTE FOR ACTIVE PARENTAL SUPERVISION, ADULT CARE, OR PROFESSIONAL EMERGENCY DISPATCH SERVICES (SUCH AS 911 OR POLICE/AMBULANCE SERVICES). SAFEOWL DOES NOT WARRANT THAT THE COVERED PRODUCT, ITS GPS LOCATOR, SOS ALERT FEATURES, CELLULAR CONNECTIVITY, OR THE PROCESSING OF CLAIMS UNDER THIS PLAN WILL BE UNINTERRUPTED, REAL-TIME, ERROR-FREE, OR PREVENT BODILY INJURY, HARM, OR ABDUCTION. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CUSTOMER EXPRESSLY WAIVES AND RELEASES SAFEOWL FROM ANY CLAIMS ARISING FROM PERSONAL INJURY, THIRD-PARTY CONDUCT, OR SAFETY INCIDENTS INVOLVING A CHILD OCCURRING WHILE A COVERED PRODUCT IS DAMAGED, DEFECTIVE, POWERLESS, OR AWAITING REPLACEMENT UNDER THIS PLAN.

SECTION 7. CANCELLATION & REFUND POLICY

7.1 Thirty (30) Day "Free Look" Period:
You may cancel this Plan for a full (100%) refund of the purchase price paid if your cancellation request is received within thirty (30) calendar days following the date of Plan purchase, provided that no claim has been authorized or paid under this Plan. If a claim has already been authorized or fulfilled within this 30-day window, no refund shall be issued. This refund applies strictly to the SafeOwl Care Plan fee and expressly excludes any cellular subscription fees, activation fees, or carrier plan charges.

7.2 Cancellation After 30 Days:
Except as expressly required by applicable state law (see Section 7.4), if you cancel this Plan after the expiration of the thirty (30) day Free Look Period, this Plan is strictly non- refundable, and no full, partial, or prorated refunds will be issued.

7.3 Statutory Proration (Where Mandated by State Law):
Where applicable state law requires pro-rata cancellation rights beyond thirty (30) days, SafeOwl will calculate any required refund based on the remaining unexpired percentage of the Coverage Period, less:

  • The cost of any claims, repairs, or replacement units provided; and
  • An administrative and processing fee equal to the lesser of 10% of the Plan
purchase price or fifty dollars ($50.00), or the maximum fee permitted under applicable law.

7.4 State-Specific Mandatory Terms:
The terms of this Section 7 are modified to conform to the statutory service contract regulations in your state of purchase or residence. In the event of a conflict between this Section and the statutory requirements of your state, your state's mandatory statutory provisions shall govern solely to the minimum extent necessary to comply with such law.

SECTION 8. GOVERNING LAW, MANDATORY BINDING ARBITRATION & CLASS ACTION WAIVER

8.1 Governing Law & Federal Arbitration Act:
This Agreement and all claims arising out of or relating to this Plan shall be governed by the laws of the State of Texas, without regard to conflict of law principles. Notwithstanding the foregoing, the arbitration provisions set forth in this Section 8 shall be governed exclusively by the Federal Arbitration Act (9 U.S.C. § 1 et seq.).

8.2 Mandatory Informal Dispute Resolution:
Prior to initiating any formal legal or arbitration proceeding, Customer and SafeOwl agree to engage in good-faith informal negotiations for a period of thirty (30) calendar days. Notice of a dispute must be sent to SafeOwl Legal (disputes@safeowl.com) containing the account details, device IMEI/serial number, and a description of the dispute.

8.3 Binding Individual Arbitration:
If informal resolution fails, any controversy, claim, or dispute arising out of or relating to this Agreement, the Covered Product, or the purchase and administration of this Plan shall be resolved exclusively through final and binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, rather than in court.

8.4 Class Action and Collective Relief Waiver:
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ALL CLAIMS MUST BE ARBITRATED OR LITIGATED ON AN INDIVIDUAL BASIS AND NOT ON A CLASS, CONSOLIDATED, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL BASIS. THE ARBITRATOR HAS NO AUTHORITY TO CONSOLIDATE CLAIMS OF MORE THAN ONE INDIVIDUAL OR OVERSEE ANY CLASS PROCEEDING.

8.5 30-Day Arbitration Opt-Out:
Customer may opt out of this arbitration agreement by submitting written notice of opt- out to optout@safeowl.com within thirty (30) calendar days of purchasing this Plan. Opting out of arbitration does not affect the validity of any other provision of this Agreement, including the Class Action Waiver.

8.6 Severability:
If any provision, clause, or sentence of this Agreement is held to be invalid, illegal, or unenforceable by an arbitrator or court of competent jurisdiction, such invalidity shall not affect the remaining provisions of this Agreement, which shall remain in full force and effect, and the invalid provision shall be deemed modified

SECTION 9. STATE-SPECIFIC STATUTORY DISCLOSURES (TEXAS RESIDENTS)

9.1 Deductible:
The deductible under this Plan is $0.00. No deductible, copayment, or administrative assessment is required to file or complete an approved claim.
